Terms of Use
1. The service
CurbMerge is a coordination tool that allows users to communicate that a lawful public curb parking space may be becoming available and to coordinate a potential handoff.
2. No ownership, reservation, or guarantee
CurbMerge does not sell, reserve, own, guarantee, or create legal rights to any public parking space. A user’s offer or claim is informational only. Availability may change at any time, and other drivers, regulations, construction, emergency activity, signage, or lawful authorities may affect access.
3. Lawful and safe use
- Do not interact with CurbMerge while driving.
- Pull over safely before using the app.
- Obey all traffic, parking, standing, stopping, accessibility, emergency, and local rules.
- Do not block traffic, reserve spaces with objects, confront other drivers, or attempt to enforce a claim.
- Do not use CurbMerge to exchange money for public parking rights.
4. Beta service
The service may contain errors, interruptions, inaccurate locations, delayed status updates, or incomplete features. Features may be changed, suspended, or discontinued without notice during testing.
5. User conduct
Users must provide truthful handoff information, avoid deceptive claims, protect shared codes, and avoid harassment, impersonation, fraud, scraping, reverse engineering, or interference with the service.
6. Location and third-party services
CurbMerge may rely on Apple Maps, TestFlight, hosting providers, device location services, and other third-party systems. Their terms and availability also apply. CurbMerge is not responsible for third-party directions, map accuracy, outages, or decisions.
7. Assumption of risk
Parking and driving involve inherent risks. Users remain solely responsible for their driving, route, parking decision, compliance with signage and law, vehicle security, and interactions with others.
8. Disclaimer
The beta service is provided “as is” and “as available,” without warranties of availability, accuracy, fitness for a particular purpose, noninfringement, or uninterrupted operation, to the fullest extent permitted by law.
9. Limitation of liability
To the fullest extent permitted by law, CurbMerge will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of time, loss of parking opportunity, fines, towing, vehicle damage, personal injury, disputes, or reliance on app information. Final limitations should be reviewed by counsel.
10. Suspension and termination
CurbMerge may limit or terminate access for misuse, unsafe conduct, fraud, abuse, legal risk, or repeated failure to honor handoffs.
11. Changes
These terms may change during beta. Continued use after revised terms take effect constitutes acceptance to the extent permitted by law.
